Erratum: AI-literacy supervision date

What the published brief says: that national supervision and enforcement of the Article 4 AI-literacy duty begins 2 August 2026 — stated without qualification, in the prose, the consolidated timeline, and the crosswalk row.

What the primary source says: both dates. The European Commission’s AI-literacy Q&A (last updated 19 November 2025) is internally inconsistent across two adjacent answers in its enforcement section: the first states that “the supervision and enforcement rules apply from 3 August 2026 onwards”; the next states that the national market surveillance authorities will start supervising and enforcing the rules as of 2 August 2026. Legal commentary has repeated the 3 August formulation.

What the Regulation says: Article 113, as amended by Regulation (EU) 2026/1744, sets general application from 2 August 2026; no 3 August 2026 date appears in that article. On the Regulation’s text alone, supervision powers exist from 2 August 2026.

Resolution: the published brief’s date stands as the reading supported by the Regulation’s text. What this erratum corrects is the unqualified certainty: the brief presented a date that its source layer states two different ways. The conflict is now part of the record. If the Commission harmonises its Q&A, a later dated brief will record which formulation survived.

How it happened: the brief’s original draft carried 3 August, sourced from the Q&A’s first formulation via secondary commentary. Pre-publication review changed it to 2 August — outside the agreed repair scope — matching the Q&A’s second formulation and the Regulation’s application date. Two reviewers each “confirmed” opposite dates from the same page; neither qualified the claim. That, not the date, is the defect this erratum records. The same review pass also added the Article 50(2) transitional period — generative systems on the market before 2 August 2026 have until 2 December 2026 to meet the machine-readable marking requirement — which was verified correct against the Commission’s Article 50 FAQ and stands. All of it is recorded in the claims ledger, entry 8.

Why an erratum rather than an edit: published briefs in this series are never rewritten; corrections accrue as dated follow-ups that reference their predecessors. This is the convention’s first exercise, one day into its existence.
